1. Acceptance of Terms

By accessing or using the SurgRisk website, app, or any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

If you use the Service on behalf of an organization (such as a hospital or surgery center), you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You may use the Service only if you are at least 18 years old and have the legal capacity to enter into a binding contract. You are responsible for ensuring that using the Service is lawful in your jurisdiction.

3. Nature of the Service (No Clinical Advice)

SurgRisk provides a platform for predicting patient-specific resource utilization and optimizing for Value-Based Care and Bundled Payments using high-fidelity synthetic data.

  • All content, analytics, simulations, examples, and outputs on or through the Service (collectively, "Content") are for informational and educational purposes only.
  • Nothing on the Service constitutes clinical advice, medical diagnosis, or treatment recommendations.
  • SurgRisk is not a healthcare provider and does not provide individualized clinical recommendations or suitability assessments.
  • You are solely responsible for any clinical or operational decisions you make. You should rely on your professional judgment and consult with qualified medical professionals before making patient care decisions.

4. Predictions and Analytics

All predictions, resource metrics, and rankings are hypothetical and based on simulated data or historical patterns. Past or simulated performance is not indicative of future clinical results. SurgRisk does not guarantee the accuracy of any prediction.

5. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must promptly notify Hypertrial of any unauthorized use or suspected security breach.

6. User Content and Intellectual Property

"User Content" includes any patient parameters, data, or other material you upload or submit through the Service. You represent that you have all necessary rights to submit it and that your submission does not infringe any third-party rights or violate any laws (including HIPAA and other privacy regulations).

You retain ownership of your User Content. You grant Hypertrial a worldwide, non-exclusive, royalty-free license to use, host, store, and analyze your User Content to operate and improve the Service, conduct internal research, and generate anonymized result sets.

7. Disclaimers

The Service and all Content are provided "as is" and "as available" without warranties of any kind.

Hypertrial does not warrant that the Service will be uninterrupted, secure, or error-free, or that any results or analytics will be accurate or suitable for clinical use. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Hypertrial and its affiliates shall not be liable for any indirect, incidental, or consequential damages (including medical errors or operational losses) arising out of or related to the Service.
